Cap_Ironman Weekly News, Week Ending 7 August 2011

So I made an awesome Steve/Tony fanvid and posted it to YouTube because that's the only video hosting site I'm familiar with. Immediately, YouTube blocked the video based on the copyright of the music used. I've submitted a dispute that the fanvid is fair use. Can anyone here tell me either a) if claiming fair use works, generally, or b) what other video hosting sites are a good alternatives?

Well, off to bed. Maybe it will be unblocked in the morning.

Sometimes it works and makes the vid avaliable worldwide, sometimes it doesn't and the vid reamains blocked for some countries, sometimes it doesn't work at all and youtube deletes your account. You could upload your vid to vimeo.com.
I'm looking forward to watching it!

I'm not sure you can claim fair use for the music, tbh? I think that applies to the subject of the vid.

I am doubtful also that the music would fall under fair use, but I read a few articles on fanvids as fair use and thought it was worth a shot. I can certainly see how the clips from a movie or a TV show are repurposed, but the music is being used fully and straightforwardly. I wish that, for example, OTW addressed the use of copyrighted music on their page about fanvids. The fanvids that they use as an example for how footage falls under fair use have songs that are not under creative commons.

I will probably just go with vimeo, as suggested above.

Yeah, as I said to [livejournal.com profile] valtyr above, I thought it was worth a shot but I'm doubtful too. The worst that will happen is that my rarely-used YouTube account is deleted.

I've had a lot of issues in the past with downloaded vids not playing for me, which has soured me on that, but it's probably not a problem for those more techsavvy than me. It's a good idea.

I know a few vidders who put their work up on Vimeo (I think you can also password protect it there).

I haven't had personal experience with Youtube copyright, but I did find a couple of posts that might be helpful:

Thank you for the links! This is my first (sort of) fanvid, so I've been reading up on the history, culture, and legality of vidding. I've found many articles on the fair use of footage for fanvids, but fewer articles on whether using a whole song in a fanvid can constitute fair use. The OTW promotes claiming fair use for fanvids on YouTube (the main reason I did so), but I'm still doubtful. I hope it works, of course, but I think posting it to Vimeo is a good idea.

There are some fanvids with the ENTIRE ARTICLE regarding fair use posted on their vids, with strict wording... you could scavenge for these vids and try what they tried if ever you need to.
